Terms & Conditions of Wimbledon Guild Waggy Walk
1. About the Event and acceptance of these terms and conditions
1.1 These terms and conditions apply to the Wimbledon Guild Waggy Walk event taking place on 2 October 2021 (the “Event”).
1.2 The Event organiser is the Wimbledon Guild of Social Welfare (Incorporated) a charitable company limited by guarantee with registered company number 383330 and registered charity number 200424 (the “Organiser”).
1.3 Only people registered for the Event with the Organiser are permitted to take part. 1.4 By registering for the Event, you agree to comply with the following terms and conditions.
2. Entry requirements
2.1 Participants must either be:
2.1.1 aged 16 or over at the date of the Event; or
2.1.2 registered by a parent or legal guardian on their behalf.
2.2 Participants under the age of 16 must be accompanied by one or more adults who agree to take responsibility for their safety at the Event.
2.3 All participants must check in at the Hand in Hand pub on the day of the Event before proceeding to walk the route.
3. Entry fee
3.1 The following fees are payable for advance bookings: £25 per family (two adults and two children) £10 per adult £5 per child (age 4-16) £5 per dog.
3.2 Entry fees are non-refundable and there is an additional Eventbrite booking fee.
3.3 The above stated fees are in relation to advance bookings only and do not apply to sales made on the day. The cost for tickets on the day will be stated at the point of sale.
3.4 All fees are inclusive of VAT.
4. Participation at the Event
4.1 By registering and paying the entry fee you are entitled to participate in the Event. You cannot sell or transfer your right to participate to another person.
4.2 Participants must ensure that they are sufficiently fit and healthy to take part in the Event and that they have proper clothing, footwear and equipment on the day of the Event. Anyone unsure of their physical ability to take part in the Event must seek medical advice from their General Practitioner prior to the Event.
4.3 The participant acknowledges that the Event is physically demanding (particularly depending on the weather conditions that day) and that he/she is aware of the medical and physical risks involved. Wimbledon Common is a large area of land that is uneven in parts, there are inclines along the route and there may be roads to cross along the route. By registering for the Event the participant warrants to the Organiser that he/she and any persons at the Event under his/her care will be sufficiently fit and healthy to take part in the Event.
4.4 The participant warrants that he/she is solely responsible for his/her actions and the actions of persons under his/her care at the Event. The Organiser shall not be responsible or liable for any injury or illness that the participant or a person under the participant’s care may suffer as a result of his/her participation in the Event (unless such injury or illness is caused by the negligence of the Organiser).
4.5 The participant agrees to abide by any guidance or instructions issued by the Organiser or a representative of the Organiser (including Event marshals) at the Event.
4.6 The Organiser reserves the right to refuse for a participant to take part in the Event on the grounds of safety or because of any inappropriate behaviour on the part of a participant, including but not limited to threatening or abusive behaviour. If a participant continues or purports to continue to take part after any such notification by the Organiser, they do so entirely at their own risk.
5. Dog walking
5.1 Each participant aged 16 or over is able to bring up to 2 dogs to the Event.
5.2 If a participant brings a dog to the Event, they must ensure:
5.2.1 the dog is well socialised and will not behave in an aggressive, intimidating or dangerous manner towards other dogs or any participants or members of the public;
5.2.2 the dog is kept on a lead at all times;
5.2.3 the dog is not permitted to disturb other users of Wimbledon Common;
5.2.4 the dog is kept under control and taken to one side if a horse is approaching;
5.2.5 they have a supply of dog-waste bags, their dog’s mess is picked up and disposed of in one of the dog-waste bins on site or else the dog mess is taken away and disposed of by the participant at their home;
5.2.6 the dog is tagged with the owner’s contact details on their collar (this is a legal requirement and we can reunite any lost dogs and their owners much more easily this way);
5.2.7 the dog has been microchipped (this is a legal requirement from April 2016);
5.2.8 the dog is up to date with vaccines and is not in season;
5.2.9 the dog is transported to and from the Event safely and securely;
5.2.10 no dog is left unattended in a vehicle during the Event.
6. Cancellation or alterations
6.1 The Organiser may alter the starting time (but not the date) or the walking route(s) of the Event and, if this is done, the Organiser will provide participants with as much notice as reasonably practicable.
6.2 The Organiser may have to cancel the Event because of circumstances outside of the Organiser’s reasonable control (a “Force Majeure Event”). For example, this may be necessary in the event of adverse weather conditions, a terrorist act or threat of a terrorist act.
6.3 If a Force Majeure Event occurs, the Organiser reserves the right to change the date of the Event and shall give participants at least 14 days’ notice of the new date of the Event. If a participant is unable to attend on the new date, the participant shall be entitled to a full refund.
6.4 If, after a Force Majeure Event occurring, the Organiser is forced to cancel the Event altogether and not re-arrange a date, the participant shall be entitled to a full refund.
7. The Organiser’s Liability
7.1 Participation in the Event is at the participant’s own risk.
7.2 Subject to clause 5.3 of these terms and conditions, the participant agrees to hold harmless, indemnify and reimburse the Organiser for any liability, costs, damages or expenses (including legal and professional fees) incurred by the Organiser in connection with any accident, loss, damage or injury arising out of the participant’s attendance at and participation in the Event.
7.3 Nothing in these terms and conditions limits any liability for:
7.3.1 death or personal injury caused by negligence;
7.3.2 fraud or fraudulent misrepresentation; and
7.3.3 any other liability which cannot legally be limited.
